Starting October 1, 2013 Nevada, NRS 202.500, will join 13 other states that ban Breed Specific Legislation. Breed Specific Legislation is legislation passed governing bodies pertaining to specific breeds of a specific species usually in a negative capacity. In Nevada’s case it prohibits any governing body to enact any law or regulations that declare a dog dangerous or vicious based solely on a breed.

Proponents of Assembly Bill 110, the American Veterinary Medical Association, stated that when it comes to pit bulls, the number one target of breed specific legislation, “controlled studies have not identified this breed group as disproportionately dangerous.” Echoing the sentiment of the AVMA, the National Association of Dog Obedience Instructors has expressed that it’s the behavior of the owners that makes these dogs’ dangers to others.

Assembly Bill 110; however, does outline the situations in which a particular dog, not its breed, can be deemed dangerous.

  • If the dog has not been provoked (defined as tormented or subjected to pain) behaves menacingly that would need a reasonable person to defend themselves against substantial harm when the dog is outside the premises of the owner or keeper or when on its owners premises not confined in a pen, cage or vehicle. This has to happen on two separate occasions within 18 months.
  • A law enforcement agency can declare a dog as dangerous only if the dog was used to commit a crime by its keeper or owner.
